Terms of Use

These terms govern your use of the Legal Finance Group client portal at legalfinancegroup.com.au. They are not your funding agreement — if we agree to fund your matter, a separate written funding agreement sets out the amount, the interest, the fees and when you repay, and that agreement prevails over these terms to the extent of any inconsistency.
1. Who we are
The portal is operated by Legal Finance Group Pty Ltd (ACN 690 811 299, ABN 31 690 811 299). General questions: support@legalfinancegroup.com.au. Requests and complaints about personal information: privacy@legalfinancegroup.com.au.
2. Who may use the portal
You may use the portal if you are at least 18 years old and either an applicant for funding, a client of ours, or a lawyer acting for one. We give access to lawyers so they can act on their client's matter; a lawyer's access is limited to the matters they are engaged on.
You must not use the portal on behalf of someone else unless we have agreed to it in writing.
If you are a lawyer, you use the portal on your client's instructions and within your professional obligations, and you confirm that your client has authorised each document and piece of information you provide. Nothing in the portal makes you our agent, or us yours, and nothing in it is advice from us to your client.
3. Your account
- Keep your sign-in details and your authenticator app secure, and do not share them. Two-factor authentication is required and cannot be turned off.
- Tell us promptly at the address above if you think someone else has used your account.
- You are responsible for what is done through your account, except to the extent it results from our failure.
- Ticking a box marked "I agree", pressing a button to accept or send, or typing your name where we ask for a signature is your electronic signature under the Electronic Transactions Act 1999 (Cth), and binds you in the same way as a signature in ink. 4. The information you give us
Everything you tell us and every document you upload must be true, complete and not misleading. We rely on it to decide whether to fund your matter and on what terms, and to meet our obligations under the Anti-Money Laundering and Counter-Terrorism Financing Act 2006.
Giving false or misleading information may mean we decline your application, withdraw an offer, or — where a facility is already in place — exercise our rights under the funding agreement. It may also be an offence.
If something you have told us changes materially while your application or facility is on foot, tell us as soon as you can.
5. Documents you upload
- You confirm that you are entitled to give us each document you upload, and that doing so does not breach anyone else's rights or any court order or undertaking.
- Do not upload documents showing a Tax File Number. We are not permitted by law to hold one. You are free to remove or black out your TFN before you give us any document, and our upload tool refuses files where it detects one. If a TFN reaches us anyway, we will remove it and destroy the original.
- Do not upload anything containing malicious code, or material you know to be unlawful.
- We may refuse, remove or destroy an upload that breaches these terms.
6. Identity verification
The law requires us to verify your identity before we fund you. When we do, we record what we checked — the type of document, who issued it, when it expires, how we verified it and the outcome — and we then destroy the copy of the document itself. We do not keep images of your identity documents once verification is complete, and we do not use a licence, passport or Medicare number as your customer number.
7. What the portal is not
The portal gives you information about your application and, if funded, your facility. It is not legal advice, financial product advice, or tax advice, and nothing in it takes into account your objectives, financial situation or needs. Your lawyer advises you on your matter. Consider obtaining independent financial advice before entering into funding.
Figures shown in the portal — balances, projected interest, estimated payouts — are indicative and are calculated from the information available at the time. The funding agreement and our formal statements govern what you actually owe.
8. Availability
We try to keep the portal available but we do not promise it will be uninterrupted or error-free. We may suspend access for maintenance, for security, or where we reasonably suspect misuse. Where we can, we will tell you first.
We may change the portal's features from time to time. We will not make a change that reduces your rights under a funding agreement already in place.
9. Our material
The portal, and the text, design and software in it, belong to us or our licensors. You may use it for your matter and print or save documents relating to it. You may not copy, resell, reverse-engineer or systematically extract any part of it.
Documents you upload remain yours. You give us permission to store, copy and process them for the purposes described in our Privacy Policy.
10. Liability
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. Your rights under the Australian Consumer Law are not affected by anything in these terms.
To the extent the law allows, we are not liable for loss that was not reasonably foreseeable, or for loss caused by your failure to keep your account secure or by information you gave us that was untrue or incomplete. Where our liability can be limited but not excluded, it is limited to resupplying the service or paying the cost of having it resupplied.
11. Suspending or ending access
You can stop using the portal at any time. We may suspend or end your access if you breach these terms, if we reasonably suspect fraud or unlawful conduct, or if we are required to by law. Ending your portal access does not end a funding agreement, and does not affect our record-keeping obligations — we keep records for the periods set out in our Privacy Policy even after access ends.
12. Privacy
Our Privacy Policy at legalfinancegroup.com.au/disclosures/privacy explains what we collect, why, who we share it with including recipients outside Australia, how long we keep it and how to access, correct or complain about it. Please read it — it forms part of your dealings with us.
13. Complaints
Write to us at support@legalfinancegroup.com.au, or about personal information at privacy@legalfinancegroup.com.au. We will acknowledge within 7 days and aim to resolve within 30 days. Privacy complaints may also go to the Office of the Australian Information Commissioner at oaic.gov.au.
14. Changes to these terms
We may update these terms. The current version is always at legalfinancegroup.com.au/disclosures/terms and carries a version number; the version you agreed to is recorded against your application. If we make a change that materially affects you, we will tell you before it takes effect, and no change applies to anything you did before it took effect.
15. Governing law
These terms are governed by the laws of New South Wales, and you and we submit to the non-exclusive jurisdiction of the courts of that State.
